Can I work in the stream if it is an emergency?

Working in or near a stream, other than to remove floatable debris, requires permits from the Department of Environmental Protection (DEP).   In cases where emergency approvals to work in the stream are needed, DEP can and often will issue emergency permits for the work after discussing it with the landowner to make sure that they understand their responsibilities.  DEP may require that a formal permit be submitted for the project in addition to the emergency permit.   A request for an emergency permit should be as a result of damage from a recent high water or because of a major failure in a structure (ie culvert pipe collapse) that was not anticipated.  Failure to allow enough time to get a regular permit for a project does not justify an emergency permit.     For information about emergency permits contact DEP at 570-327-0529.
